On a recent Sunday evening, the Nevada police were called to an accident said to be the 10th fatal road accident in Henderson this year. An accident report indicates that the crash is suspected to be the result of drunk driving. Reportedly, the deceased man was traveling on a motorcycle when he was rear-ended by a car that was allegedly traveling at a high rate of speed.
Police said the impact caused the motorcyclist to smash into the guardrail, causing his death. The 38-year-old driver of the car allegedly continued driving for some distance before abandoning his vehicle and fleeing on foot. He was later located and arrested on charges of causing a DUI accident that resulted in death and also fleeing an accident scene where injury or death was apparent.
The accused man’s blood alcohol concentration level was not mentioned, nor how and when it was determined. The BAC level is central to any DUI case and is .08 percent for adult drivers. The methods used to test a driver’s level of intoxication is also vital, and variations from accepted protocols can be challenged in court.
The fact that this man was arrested for drunk driving charges does not mean he will be found guilty in a Nevada courtroom. However, in the event of a conviction, the consequences can be severe.
